These Terms and Conditions set out the rights and obligations of all users regarding the use of the Website.
Your access to and use of the Website is conditioned on Your acceptance of and compliance with these Terms and Conditions.
These Terms and Conditions apply to all visitors, users and others who access or use the Website.
By accessing or using the Website You agree to be bound by these Terms and Conditions.

If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18.

Your access to and use of the Website is also conditioned on Your acceptance of and compliance with our Privacy Policy. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Website and tells You about Your privacy rights and how the law protects You.

Use of our embroidery designs

You must have an embroidery machine in order to use our designs. These are digital files and NOT a finished products.
Our designs come in the following formats only: DST, EXP, HUS, JEF, PES, PEC, VIP, VP3 and XXX. All designs include production worksheet in PDF file.
We do NOT provide any other design formats.

Our designs are available for instant download after payment is made.

Sharing Policies

By purchasing our designs, you are purchasing a LICENSE to use them. Only the actual purchaser of the designs holds this license. This license is NON-transferable. You may not at any time, sell, trade, share or give away the embroidery files. You may not use our design as a basis to create a new design and call it your own. You may not alter designs and call them your own or sell the altered designs.

You may edit the designs for your own personal use.

We reserve the right to immediately and without notice terminate any account holder who is known to be sharing designs. ALL design downloads will be terminated. Those violating our terms of use will lose the abilities to download the files.

Using our designs on items for sale

We encourage the use of our designs to be stitched on items You sell. Our designs may be stitched on items to be sold as long as they are not mass-produced. As long as only the individual purchaser sews the designs, there is no limit to the number of times you may stitch them on items for sale. Designs used on items for sale must be purchased. You may NOT use our FREE designs on items for sale.

While you may stitch the designs on items to be sold, you may not claim to be the creator/designer of the designs themselves. Most of our designs are digitized from artwork purchased with the appropriate license. However we are not the sole owners of these images and it is possible that you will also see them on other websites.

Use of images from our website

It is strictly forbidden to use any of our images.

Your Account

Please do not share your login or password with anyone. All downloads are tracked and monitored on a regular basis. If we find designs being downloaded to multiple computers of one account holder, downloading abilities will be suspended without notice and further rights to future downloads will be revoked.

It is highly recommended that you download your designs upon purchase. Our unlimited downloads are for your convenience only and Embroidery Escape reserves the right to change this policy at any time. Designs will remain available for download as long as the website exists.

Refunds and exchanges

Due to the digital nature of our designs and their ability to be downloaded instantly, refunds and exchanges are not offered. If you have difficulty downloading your file, or if there is an issue with the design please send us an email and we will assist you as son as possible. Please note that we are closed on weekends and all major holidays.

Stitching issues with our designs

All designs are tested for quality prior to release. If you are having stitching issues, please email us for support at info@embroideryescape.com and we will be happy to assist you. Embroidery Escape is not liable for items that may be harmed during a stitch out. If you are stitching onto an expensive item it is highly recommended that you do a test stitch-out PRIOR to your main embroidery, as results may vary depending on your fabric, stabilizing, hooping etc.

We do NOT provide reimbursement or compensation for damaged embroidery blanks including clothing, bags, towels etc. It is a common embroidery practice to do a test before stitching onto a final item.

Embroidery editing software

Our designs are manually digitized. All designs are tested prior to availability, and quality is guaranteed in the files and sizes that we provide. We are UNABLE to guarantee a designs quality if it has been resized, edited, merged, or opened in software that may alter the settings of the design.
If embroidery editing software is used to open, edit, and export a design, it is important that you are proficient with the software.
We are unable to provide support should a problem arise due to too many variables in all of the software programs.

Disputes Resolution

If You have any concern or dispute about the Website, You agree to first try to resolve the dispute informally by contacting the Embroidery Escape.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Website after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Website.
